The eb5 was created by the immigration act of 1990 through congress and is known as Employment Based Fifth Preference Category. It allows foreign nationals to invest into the United States and become permanent residents. 

In 1993 Congress enacted the Appropriations Act and amended the EB-5 program that allowed investors to fund through Regional Centers approved by the United States Citizenship and Immigration Services (USCIS) known as the Immigrant Investor Pilot Program (IIPP). 

This gave foreign nationals the added benefit to count jobs created both directly and indirectly in meeting at least 10 American workers  requirement.

If the USCIS decision is unfavorable and you are denied the application for the Eb5 visa program then all monies paid will be refunded as they are placed in a secured escrow until decision is granted or denied. If denied the amount is wired back to you in full.

Timeline on permanent residency

How Long does it take to get permanent residency ?

From the beginning of application approval until permanent residency should take up to 5 ½ years depending on the quickness of processing for the USCIS. There is currently a backlog for China-mainland applicants are expected to take longer than other country applicants.

All eb-5 investment by law are classified as “at risk” and could not guarantee a return on investment.  

However, prior to investment and during due diligence you can see how a project or regional center has performed in the past although this does not guarantee future investment.

Any foreigner and their family who wish to eventually become citizens of The United States

The main investor, their spouse and unmarried child ages 21 or under (even if adopted) are eligible to become citizens of the United States through the eb-5 investment visa program.

  • Investment of $900,000 (gifted money is acceptable however must show the source of funds)
  • Must create directly or indirectly 10 U.S. jobs. 
  • If the investor was gifted the investment amount, it must be  without obligation to repay it as a loan even after permanent residency is granted. 
  • Must pass other general requirements by the USCIS
